Tool Gate · How it works
How the AI Notetaker Compliance Tripwire gate works
How the AI Notetaker Compliance Tripwire scores a notetaker deployment across weighted controls — then two fatal controls (consent and human review) trip a tripwire to NOT DEFENSIBLE when either is at zero, so a high score still fails without recorded consent or a human in the loop.
How the gate works
This tool grades each AI meeting notetaker in an advisory firm on six controls, two of them fatal, before an exam. Each control is marked from your own evidence and weighted into a 0–100 score — and then the score is run past a gate that can only make the verdict worse.
The 6 weighted controls
| Signal | Weight |
|---|---|
| Client consent & disclosure before capture | 20 |
| Human review before notes enter the record | 20 |
| Retention & recordkeeping treatment | 16 |
| Vendor due diligence documented | 16 |
| Written supervisory procedures updated | 16 |
| Authorized & inventoried (not shadow AI) | 12 |
| Total | 100 |
The verdict bands
Two of the six controls are fatal: client consent before the tool captures a meeting, and a human review before AI notes enter the client record. If either is absent, the tool is NOT DEFENSIBLE regardless of the score — no paperwork offsets a meeting captured without consent or a summary filed with no one checking it. Turn the missing control on and the wire releases.
In the worked sample it scores 80 out of 100 and still reads NOT DEFENSIBLE — This Copilot deployment is cleanly documented — consent captured, retention, vendor diligence, supervisory procedures, and inventory all in place — for a score of 80 that on points alone reads DEFENSIBLE. But its AI notes are filed with no human review, the second fatal control. The tripwire fires: a strong process can't rescue a missing fatal control, so the verdict is NOT DEFENSIBLE, not DEFENSIBLE. The one thing to fix first: Human review before notes enter the record — add a review step so a person checks each AI summary before it becomes the client record. It's the one fatal control this tool is missing, and clearing it moves the verdict off NOT DEFENSIBLE..
Common questions
Can something score well on the How the AI Notetaker Compliance Tripwire works and still fail?
Yes. The weighted score is run past a worsen-only gate — the Tripwire — that can only make the verdict worse. In the worked sample it scores 80 out of 100 and still reads NOT DEFENSIBLE, because this Copilot deployment is cleanly documented — consent captured, retention, vendor diligence, supervisory procedures, and inventory all in place — for a score of 80 that on points alone reads DEFENSIBLE. But its AI notes are filed with no human review, the second fatal control. The tripwire fires: a strong process can't rescue a missing fatal control, so the verdict is NOT DEFENSIBLE, not DEFENSIBLE.
What is a worsen-only gate?
A dispositive rule that can only lower a verdict, never raise it. One fatal flaw overrides an otherwise-good score, because a single disqualifying gap shouldn't hide behind a high average. The tool also names the one thing to fix first — here, "Human review before notes enter the record — add a review step so a person checks each AI summary before it becomes the client record. It's the one fatal control this tool is missing, and clearing it moves the verdict off NOT DEFENSIBLE.".
Not legal advice. A deterministic readiness aid that grades your process from your own marks — it renders no legal ruling, makes no reportability or books-and-records determination, and scores no person. Regulatory specifics move; confirm consent law, recordkeeping, and supervisory duties with your compliance counsel before relying on any tool.
