Tool Gate · How it works
How the AI Literacy Evidence & Article 4 Readiness Kit gate works
How the AI Literacy Evidence & Article 4 Readiness Kit rolls your in-scope roles up to the weakest: an untrained-operator gate forces a role to UNEVIDENCED, and the weakest role sets the headline — so a program with strong average coverage still reads NOT DEFENSIBLE if one role has no evidence.
How the gate works
This tool grades each in-scope role's AI-literacy evidence - inventory, role-to-system mapping, training record, and proportionality - then rolls the organization up to its weakest role. It reads 4 roles and rolls them into one verdict — the worst, never the average — and then a gate that can only make it worse.
The 4 roles
| Role | Verdict |
|---|---|
| Support agents · AI reply drafting | EVIDENCEDscore 100 · inventory, mapping, training, proportionality all on file |
| Marketing · AI copy tools | EVIDENCEDscore 79 · evidenced |
| Sales reps · AI CRM assistantfix first | UNEVIDENCEDgate · operates AI with a zero training record · score 47 would read PARTIAL |
| Recruiters · AI screening | UNEVIDENCEDscore 32 · thin inventory, mapping, and training |
The verdict bands
A role that operates an AI system with no training record is UNEVIDENCED regardless of its other scores — you cannot evidence Article 4 AI literacy for people using AI with nothing on file. One such role forces the whole organization to NOT DEFENSIBLE, and the headline is the weakest in-scope role, never the average.
In the worked sample it reads NOT DEFENSIBLE — Two roles are fully evidenced (100, 79) and the mean reads 65 - but the headline is the weakest in-scope role, not the average. Sales reps operate an AI CRM assistant with a training record at zero, so the untrained-operator gate forces that role to UNEVIDENCED even though its 47 would otherwise read PARTIAL; Recruiters sit at 32. Any UNEVIDENCED in-scope role makes the organization NOT DEFENSIBLE. (Finance uses no AI and is out of scope.) The one thing to fix first: Sales reps (AI CRM assistant) - they operate an AI system with no training record, which the gate treats as UNEVIDENCED regardless of score. Put a training record on file for that role first; Recruiters (32) still need lifting before the org reads DEFENSIBLE..
Common questions
Can every role look survivable on the How the AI Literacy Evidence & Article 4 Readiness Kit works and the company still read NOT DEFENSIBLE?
Yes. The roll-up takes the worst of 4 roles — never the average — then a worsen-only gate, the Untrained-operator gate gate, escalates when trouble clusters. In the worked sample it reads NOT DEFENSIBLE because two roles are fully evidenced (100, 79) and the mean reads 65 - but the headline is the weakest in-scope role, not the average. (Finance uses no AI and is out of scope.)
What is a worsen-only gate?
A dispositive rule that can only lower a verdict, never raise it. One fatal flaw overrides an otherwise-set of survivable lines, because a single disqualifying gap shouldn't hide behind an average of the healthy ones. The tool also names the one thing to fix first — here, "Sales reps (AI CRM assistant) - they operate an AI system with no training record, which the gate treats as UNEVIDENCED regardless of score. Put a training record on file for that role first; Recruiters (32) still need lifting before the org reads DEFENSIBLE.".
Not legal advice. This kit builds an evidence record; it does not certify compliance, is not a conformity assessment, and scores no person. The EU AI Act Article 4 AI-literacy obligation has applied since Feb 2025, with penalty and governance provisions phasing in from Aug 2025, and the dates shift as the Commission's Omnibus simplification package settles. Confirm your current obligations with qualified counsel.
